Whenever an application for an HP permit is denied, no subsequent application which
is the same, or substantially the same, may be submitted, filed or reconsidered for
a period of one year from the effective date of the final action; provided, that an
application may be withdrawn by the applicant at any time prior to the first public
hearing conducted by the director of planning, and such withdrawal shall not be considered
a denial of such application.
