§ 15.16.700. Sewer connection fees - Credits for assessments.
A.
This section shall apply only to land connected to the sanitary sewer after the effective date of this ordinance where such land has been assessed pursuant to special assessment proceedings to pay for the cost of permanent sanitary sewer facilities which, at the time the applicable sanitary sewer connection fee is paid pursuant to the provisions of this part and Part 4, are facilities owned by the City of San José or are facilities in which the city has a right to discharge sanitary sewage.
B.
Where the cost of such permanent sanitary sewer facilities has been assessed against the land described in Subsection A, above, such costs shall be credited against the particular sanitary sewer connection fee which would otherwise apply to such land. In the event the amount of such credits for assessments exceeds the applicable sanitary sewer connection fee for such land, such excess credits for assessment shall be extinguished and shall not be applied against any future sanitary sewer connection fees.
C.
The credit for assessment under this section shall be calculated in accordance with the following formula:
Total construction and installation costs of facilities, determined in accordance with the schedule set forth below and entitled "Formula for Determining the Total Construction and Installation Costs of Facilities".
Multiplied By
Area of particular pieces of land for which
